State's story: my client got upset about the family cat peeing all the time in the house, and so he killed it (he didn't mean to, but he was reckless in trying to punish and correct the behavior), and, once police investigated, they learned he had raped his significant other and he had been doing the same to his biological daughter; client also beat up significant other/mother and daughter one time each on separate occasions. Our story: the mother was making up the rape as she was upset about the cat and being physically abused by my client, and the daughter fabricated stuff in solidarity with her mother's efforts to have State remove client from the home and their lives by way of this prosecution. We denied the assaults and harassment but the jury convicted on the State's stories about those situations. Actual verdicts were: Count 1: child molestation second degree: not guilty; Count 2: rape of a child second degree: not guilty; Count 3: attempted rape of a child second degree: not guilty; Count 4: rape of a child second degree: not guilty; Count 6: child molestation third degree: not guilty; Count 7: assault 2 dv: guilty; Count 8: rape second degree DV: not guilty; Count 9: assault 4 DV: guilty; Count 10: animal cruelty first degree: guilty; Count 11: felony harassment dv: guilty
State's story: our client would seek out very expensive, high-end homes that were for sale and execute purchase agreements and simultaneously move in as a tenant with no intent to actually complete the sales by actually paying the agreed purchase price to become the owner. Our story: our client made every effort to become the owner of several homes and all the parties were sophisticated sellers who understood and negotiated the deals with eyes wide open, being fully informed and agreeing to the terms of the deals they entered into with our client. The jury agreed with some of our stories; our efforts resulted in a better resolution than offer to settle the case made before trial. Jury also convicted on 3 counts of Mortgage Fraud.
