Implied Acquittal: jury hung on Vehicular Assault and guilty on lesser included crime of DUI

State's story: my client was very alcohol intoxicated and crashed the car causing the front seat passenger's serious injuries.  Our story: the passenger grabbed the steering wheel and yanked it causing the crash.  More jurors were in favor of not guilty than guilty. State cannot try the case again on an implied acquittal. 

Dismissed: assault 2 with Deadly weapon enhancement

State's story: my client decided to attack and stab a man for no reason.  Our story: my client was being attacked by the other man because he was upset about issues involving my client and the other man's younger sister, and my client was acting in self defense.  We accepted a deferred sentence on an assault 4 (misdemeanor) conviction which was dismissed with prejudice after completion of some probation. 

Not guilty: Assault 2

State's story: my client decided to randomly punch a woman at an EDM/Rave causing her extensive facial injuries.  Our story: my client was the wrong guy, some other man did it, not my client.  

Jury agreed with the Defense story and acquitted. 

Not guilty: Felony Harassment DV with aggravator of ongoing pattern of psychological/physical/sexual abuse; jury hung: rape 2 and Rape 3 DV; guilty: assault 4 (misdemeanor) DV

State's story: my client is a violent and jealous man who perpetrated multiple felonies against a woman he had been dating for some time.  Our story: the woman was fabricating the case because she was the jealous one as my client started seeing another woman and had left the accuser for the other woman.  Jury agreed with the Defense story on the most serious sex offenses and felony harassment.

Dismissed: Vufa 2 (illegal firearm possession)

State's story: my client was stopped for speeding and trooper decides to search car for weapons after asking for consent.  Our story: the trooper had no basis to expand the scope and duration of a speeding ticket infraction stop to start an investigation for weapons.  Judge agreed and suppressed the evidence, case dismissed. 

Dismissed: Assault 1 and VUFA 1

State's story: my client shot a man with a pistol it was illegal for him to possess.  Our story: the man had the pistol and shot himself when he tried to pull the pistol out of the waistband of his pants.  State agreed with Defense story and dismissed the case. 

Not guilty: Robbery, guilty of lesser included theft 3 (misdemeanor)

State's story: my client committed a shoplift and punched the store clerk on the way out while taking the merchandise. Our story: nobody got punched, this was just a shoplift.   Jury agreed with Defense story and found not guilty of the felony and convicted of a misdemeanor.

Not guitly: VUFA 2 (illegal firearm possession)

State's story: my client shot a pistol into the air while standing outside a car in a neighborhood and it was illegal for him to be possession of the gun.  Our story: the other man standing next him was the person who possessed and fired the gun which the police found in the car.  Jury agreed with the Defense story and acquitted.    

Reduced charge: Attempted Commercial Sexual abuse of a minor reduced to patronizing a prostitute

State's story: my client emailed and texted a minor child for sex that was actually an undercover detective trying to entrap my client.  Our story: my client thought he was emailing and texting an adult and the police were overreaching.  State agreed and offered a simple misdemeanor that my client accepted.  

NOT GUILTY: Attempting to Elude a pursuing police officer; Guilty: DUI

State's story: my client was very drunk driving and trying to speed and swerve away from the cops so he would not be arrested for DUI.  Our story: my client was actually barely illegally intoxicated and was simply driving home as he usually did in his sports car.   Jury agreed with the Defense story and acquitted on the felony, convicted on only the DUI.

REDUCED CHARGES: Theft 1 + major economic aggravator, reduced to attempted theft 2 (misdemeanor)

State's story: my client stole over 1 million dollars from a trust account he was hired to preside over.  Our story: my client made some investments with the money as per his duties and this was simply a case of the market fluctuating which caused the losses.   State agreed with our story and offered my client a misdemeanor offer he accepted. 

Dismissed: rape 3

State's story: my client had nonconsensual sex with a woman; our story: it was consensual sex and we wanted to talk to a jury as we were sure they would agree.   State did not want to take its chances with a jury and agreed to dismiss the case before trial.
